On Monday, District Attorney Brooke Jenkins released footage from a Walgreens security camera showing guard Michael Earl-Wayne Anthony shooting Banko Brown.
The video, from a ceiling-mounted surveillance camera, does not include audio but otherwise shows events clearly. We have annotated the one-minute-long section of the video when Anthony and Brown first clashed until shortly after Anthony shot Brown, slowing down and annotating different developments in their altercation.
On Monday, Jenkins announced that she would not press charges against Anthony. You can read the district attorney’s 25-page report outlining her decision-making here, and watch the nearly seven-minute long unedited surveillance footage here.

Was this guard trained in de-escalation? Isn’t pulling a gun on someone a last resort ?
Bring SFDA Jenkins to Justice. She is an accomplice in the Banko Brown MURDER!
In deed. I concur
Anthony shot Banko for spitting on him. There was no knife.
Jenkins prosecuted a case against Thomas Ortiz that went on for years. Ortiz’s attorneys, the SF Public Defender’s office, got him off on a dubious self-defense claim. Jenkins knows she is no match against the Public Defender’s office in self-defense cases. I have a hard time believing the Ortiz case didn’t didn’t factor heavily into Jenkins’ decision making. She hasn’t forgotten.

I think the guard should be liable of voluntary manslaughter, not murder.
If you read the report, you’ll see that there is corroboration coming from witnesses that Banko kept threatening Anthony after being let go. Also, the witness does refer to the fighting ”stance” taken by Brown right before the shot.
To me, it’s voluntary manslaughter because Anthony chose to shoot and he showed disregard for Brown’s life although not clear intent to kill (given the 1 shot and the aftermath “just breathe” interaction). He was acting “in the heat of the moment”.
To me it’s not self defense because Brown, after threatening and taking the “stance”, starts to walk back. Also, a “fighting stance” from someone 6in smaller than you who you just came from successfully beating in a fist fight cannot, in all seriousness, be seen as a threat to life.
I hope for a measured look into this but even homicides became political now. I’m not very optimistic.
When someone steals from a store they shouldn’t be shot dead. But when someone is caught stealing from a store and is confronted by the stores security and then continues to try to walk out of the store with the stolen merchandise as if they’re entitled to it, then you’ve just got to expect bad things to happen. Otherwise we can just give up now on having a civilized society. But what do I know…I’m actually expecting the idiocracy to actually elect criminal insurrectionist Donald Trump president AGAIN in 2024.
Maybe M Knight Shamathon was on to something with that bad movie where the environment just kills us all? Reset button…
Banko Brown is clearly unarmed and backing up as if in retreat when Anthony calmly and casually shoots him in the chest. This is not reasonable self-defense. Commenters who believe Banko Brown earned his death do not know or understand the law on self-defense.
When a D.A. decides a murder victims current and past issues are not worth pursuing justice for them…we have a real problem people. That’s what this is all about. We’ve seen the tape that demonstrated NO SELF DEFENSE something that was tried but too many professionals have made it clear this is not the case. As a district attorney we choose to decline justice for Banko because of tranny black homeless theft history and blah blah blah. A jury would have sentenced the guard.
