After roughly two days of deliberation, the 12-person jury in the case against Sterling Samm, a 21-year-old from San Pablo, delivered its verdict Monday afternoon: not guilty on all counts.

Samm was facing charges of robbery, attempted robbery, felon in possession of a firearm and murder for the shooting death of Jose Matias-Aguilon in October of 2012. Matias-Aguilon was shot near Mr. Pickles Sandwich Shop on 20th and South Van Ness, and later died at the hospital.

“They jury reached the right decision in concluding that the lack of physical evidence and witness descriptions showed that Mr. Samm did not commit the killing,” said San Francisco Public Defender Jeff Adachi. “He is very relieved that he was acquitted.”

Samm’s release from county jail is still being processed as of 4:30 p.m. Monday, according to the San Francisco Sheriff’s Department. He has been in custody since the day he was arrested — October 30th, 2012.

  1. I hope this guy changes his life & considers this a fresh start. If he continues to live a life of crime hurting people he will find out that Karmas a mother fucker.
    What about the minor involved? What happened to him?
