According to the San Francisco Public Defender’s Office, condoms have popped up as evidence in multiple low-level prostitution cases over the past year. A 1994 city policy states that prosecutors are prohibited from using unopened condoms as evidence against suspects or taking them from the scene of the arrest. Condoms are to be collected only if the crime is a sexual assault.
