The San Francisco Planning Commission unanimously approved on Thursday the permit that would legalize the restaurant La Torta Sabrosa on Mission Street.

The self-described “mom and pop” restaurant at 2859 Mission Street has operated since 2004. The owners  thought they had the required permits for the restaurant when they “walked in,” according to Edgar Oropeza of the Planning Department.

They discovered otherwise when they tried to change the name of the restaurant. Previously it was La Loma Neveria, a café, according to planning commission documents.

Oropeza urged the commission to approve the permit saying the the restaurant had no health code or building violations and it serves the neighborhood well.

It is unclear how many restaurants seek permits for their businesses once they are actually opened, but this is the latest one after Mission Mini’s health code drama.
