Supporters of same-sex marriage are holding a sit-in this morning outside the state supreme court during a Proposition 8 hearing.

NPR reports that “The arguments will focus not so much on same-sex marriage itself, but on Proposition 8, the voter-approved initiative banning such marriages. A federal judge has ruled Prop. 8 unconstitutional and the issue before the court on Tuesday is whether proponents of the initiative have the legal authority, or standing, to pursue an appeal.”

There were fewer BART protesters at Civic Center on Monday but organizers said that another protest is planned for this Thursday at 5 p.m.

The San Francisco Chronicle reports that “By shutting down the fare gates at 5 p.m. Thursday, the protesters hope to force BART officials to open the emergency gates and let passengers at the station leave without paying their fares, said Krystof Lopaur, an organizer for No Justice, No BART.

If BART officials refuse to open the fare gates for the protests, as they would after a baseball game, then it will prove that their main concern isn’t public safety, but blocking the protest, Lopaur said.”
